Maratea elected TCU national president

The Transportation Communications International Union (TCU)/International Association of Machinists and Aerospace Workers (IAM) elected Arthur Maratea national president to fill the interim position vacancy created by the retirement of Robert Scardelletti.Previously, Maratea has served as TCU/IAM Executive Council national vice president, special assistant to the TCU president, and head of TCU’s industry relations and social services departments.Maratea has extensive experience in contract negotiations throughout the union and has been a prominent figure in coordinated bargaining with various other rail labor unions, union officials said in a press release.Maratea also served as vice chairman of the Cooperating Railway Labor Organizations (CRLO), a group of 12 rail labor unions that oversee collective bargaining for benefits on behalf of railroad members.Brotherhood of Locomotive Engineers and Trainmen National President Dennis Pierce has been elected CRLO chairman to succeed Scardelletti, who served as chairman for 19 years.

The Pennsylvania Department of Transportation (PennDOT) has opened the application period for 2020 Rail Transportation Assistance Program (RTAP) and Rail Freight Assistance Program (RFAP) grant funds.

The RFAP provides financial assistance for freight-rail infrastructure projects. The program's intent is to preserve essential freight-rail service where economically feasible and preserve or stimulate economic development through the generation of new or expanded freight-rail service.

Report: Private-equity firms discuss bid for KCS

A consortium of private equity investors is considering a possible takeover bid for Kansas City Southern, the Wall Street Journal reported July 28.The newspaper reported that the Blackstone Group Inc. and Global Infrastructure Partners are exploring a potential buyout that could be worth more than $21 billion.The firms together are exploring a potential deal and speaking to banks, including Citigroup Inc., about financing, people familiar with the matter told the newspaper.The deal provides a bet on the increase in U.S.-Mexico trade, given that KCS' rail network operates in both countries, the paper reported.KCS was the subject of merger or acquisition rumors a month ago, Seeking Alpha reported.KCS President and Chief Executive Officer Patrick Ottensmeyer addressed the earlier media reports in response to a question during a July 17 conference call with analysts following the company's second-quarter financial report. Those media reports appeared to becoming out of Europe or London, Ottensmeyer said."Obviously, you know, the standard answer is no comment on things like that," Ottensmeyer said, according to a transcript of the call. "But the story behind that is that we've got a terrific plan, we've got outstanding opportunities, we have a lot of runway to have a successful run as a independent, standalone publicly traded company and that's our focus and that's what we're going to do."

The Metropolitan Council yesterday announced it will explore alternative routes for the planned Blue Line light-rail extension in Minneapolis after failing to reach an agreement with BNSF Railway Co. to use the Class I’s right of way. 

After years of discussions, Met Council, Hennepin County and other elected officials could not reach an agreement regarding collocation of light rail and freight rail in the Bottineau Corridor.

He served as chair of the Finance Committee and a member of the Audit Committee before resigning for health reasons in November 2017.Earlier in his career, he served as the Class I's chief financial officer before taking the helm of Canadian Pacific Hotels and eventually moving the company's properties to the Fairmont Hotels & Resorts banner."Bill Fatt was a consummate business leader, with the background, financial knowledge and overall gravitas to take on big challenges and turn them into successes," said CP President and Chief Executive Officer Keith Creel in a press release. STB issues final rule on market dominance

The Surface Transportation Board (STB) yesterday announced it adopted a final rule to establish a streamlined approach for pleading market dominance in rate reasonableness proceedings.The final rule provides an option for simplifying the market dominance inquiry, which can be costly and time-consuming especially in smaller cases.The STB in September 2019 issued a notice of proposed rulemaking that laid out factors that could establish a prima facie showing of market dominance. After receiving numerous comments on the proposed rule, the board adopted the rule with modifications, STB officials said in a press release.The final rule sets for the following seven factors that a complainant must demonstrate:
• The movement has a revenue-to-variable cost ratio of 180 percent or greater;
• The movement would exceed 500 highway miles between origin and destination;
• There is no intramodal competition from other railroads;
• There is no barge competition;
• There is no pipeline competition;
• The complainant has used trucks for 10 percent or less of its volume (by tonnage) subject to the rate at issue over a five-year period; and
• The complainant has no practice buildout alternative (regardless of transportation mode) due to physical, regulatory, financial or other issues.Complainants who can't make the showing under those factors still would have the option to use the non-streamlined market dominance approach to prove market dominance, STB officials said.Under either approach, defendant railroads would continue to have the opportunity to rebut a complainant's evidence, they added.The STB also announced that it would soon initiate a proceeding to further explore the adoption of various commodity-specific thresholds, including for chlorine and agricultural products.The final rule, which can be read here, will go into effect Sept. 5.

The Jacksonville Port Authority (Jaxport) in Florida late last week welcomed the Siem Confucius, the world's first vehicle carrier of its size operated by liquefied natural gas (LNG).

The vessel arrived at Jaxport from Veracruz, Mexico, and unloaded factory-new Volkswagen Group of America cars and SUVs at the port's Blount Island Marine Terminal. It was the vessel's maiden voyage to the United States, Jaxport officials said in a press release.

The layoffs are in addition to retirements and vacant positions that will not be filled. In total, 80 VIA Rail positions will be affected.

SacRT receives funding for light-rail improvements

The California Department of Transportation last week awarded the Sacramento Regional Transit District (SacRT) $3.75 million in Low Carbon Transit Operations Program (LCTOP) funding to assist with mobility improvement projects, including light-rail modernization. 

The funding will help support the purchase of additional low-floor light-rail vehicles, and the continued operations of expanded evening light-rail service along the Gold Line in Folsom, California. Funding will also support SacRT bus operation improvements.

The San Diego Metropolitan Transit System's (SDMTS) security officers this week will begin testing a new use-of-force policy. 

The new policy bans officers from using carotid restraints and chokeholds, including the prohibition of using knee pressure on a person's neck, throat or head. The policy also requires use of force to be proportional to the seriousness of the subject’s alleged offense; instructs officers to intervene if witnessing excessive force by another employee; and requires officers to give a warning to an individual prior to use of force.
